These Terms of Service ("Terms") govern your access to and use of AI Cineworks ("the Service"), operated by Mico Studio (M) Sdn Bhd ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.

2. Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to generate:

• Content that is illegal, harmful, threatening, abusive, or defamatory.
• Deepfakes or realistic likenesses of real people without their explicit consent.
• Content that infringes on the intellectual property rights of others.
• Sexually explicit content involving minors.
• Content intended to deceive, defraud, or manipulate others.

We reserve the right to remove any content and suspend any account in violation of these rules without notice.

4. Intellectual Property

You retain ownership of content you upload to the Service. For content generated by the Service using your inputs, you are granted a non-exclusive licence to use it for personal and commercial purposes, subject to the terms of the underlying AI model providers (including ByteDance/Seedance). We make no claim of ownership over your generated outputs.

5. Tokens and Payments

• Access to generation features requires a Token balance.
• Tokens are consumed upon each successful generation.
• Tokens are non-refundable once consumed.
• We reserve the right to adjust Token pricing and consumption rates with notice.
• Unused Tokens have no cash value and are not redeemable.
• All purchased Tokens must be used within 90 days from the date of purchase. Any unused Tokens remaining after 90 days will be automatically cleared from your account with no refund or compensation.

6. Third-Party AI Models

The Service uses AI models provided by third parties, including ByteDance (Seedance 2.0). Output quality, availability, and capabilities depend on these providers. We are not liable for changes, outages, or limitations imposed by third-party model providers.

7. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee that generated content will meet your expectations, be accurate, or be free from errors. AI-generated content may be imperfect, inconsistent, or unexpected.

8. Limitation of Liability

To the maximum extent permitted by law, Mico Studio (M) Sdn Bhd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or business opportunity.

9. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will endeavour to provide reasonable notice for significant changes.

10. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
